Many New York rideshare passenger injury claims settle for somewhere in the thousands to low six figures depending on the injury; short answer: in Queens, your medical bills usually start under no-fault first, and the blame fight happens after that.
If you were a passenger, you usually do not have to figure out fault before treatment starts. In New York, the first layer is no-fault benefits from the vehicle you were riding in or its insurer. That can cover medical bills, part of lost wages, and travel to appointments, up to $50,000 on a basic claim.
The clock starts fast. A No-Fault Application (NF-2) usually must be filed within 30 days of the crash. Miss that and the insurer may try to deny benefits. If police came, get the NYPD accident report number. If they did not, and there was injury or over $1,000 in damage, a report to the New York DMV is generally due within 10 days on form MV-104.
Behind the scenes, this is what usually happens: the insurer opens a no-fault claim, asks for basic crash details, then starts requesting records and sometimes sends you to an IME doctor exam. Separately, there may be a bodily injury claim against the driver who caused the crash. If your Uber was a TLC-plated vehicle in New York City, there is usually a commercial policy in play, and the NYC Taxi and Limousine Commission can also have trip and driver records.
Right now, do the practical stuff:
- Get photos, screenshot the Uber trip, save driver and plate info, and keep every ER, urgent care, and pharmacy record.
- Don't give a recorded statement to the other driver's insurer.
- If the crash involved a pothole or bad roadway in Queens, note it, but city road defect claims are a separate track and 311 complaints often matter later.
If the crash was a hit-and-run or coverage falls apart, MVAIC may become part of the process for uninsured New York claims.
