If you were a passenger, you usually do not have to figure out fault before treatment starts. In New York, the first layer is no-fault benefits from the vehicle you were riding in or its insurer. The clock starts fast. A No-Fault Application (NF-2) usually must be filed within 30 days of the crash. Miss that and the insurer may try to deny benefits. If police came, get the NYPD accident report number. If they did not, and there was injury or over $1,000 in damage, a report to the New York DMV is generally due within 10 days on form MV-104.

Behind the scenes, this is what usually happens: the insurer opens a no-fault claim, asks for basic crash details, then starts requesting records and sometimes sends you to an IME doctor exam.
